50The 50-Employee Crossover

Crossing the 50-employee mark triggers Applicable Large Employer (ALE) status. In Texas, the 2026 mandates are strict:

  • The ACA Penalty: You must offer affordable coverage to 95% of staff or face IRS penalties of up to $3,340 per employee in 2026.
  • 9.96% Affordability: For 2026, the threshold is 9.96%. We ensure your PEO plan meets these wage safe harbors to avoid expensive "Pay-or-Play" traps.

TXSUTA & The 8-Quarter Rule

Texas allows PEOs to use their own SUTA account or yours. The wrong choice can create a "Tax Trap" when you leave.

  • SUTA Pass-Through: With low turnover, using your own TWC rate (as low as 0.32% in 2026) is often much cheaper than a PEO’s master account rate.
